These terms of use ("Terms") shall guide the access and use of Woconews' services (the "Services"), and any given information, text, graphic and other materials carried and available in the Services (collectively denominated "Content"). The acceptance and compliance with these Terms by the user are a condition for the access and utilization of the Services. The user is responsible for the use of the Services, for any content that he/she posts on the website and for all the consequences thereafter. The content sent, posted or exhibited by the user can be seen by other users of the Services and by third parties and websites. The user may only release content that can be shared with other people according to these Terms.
In order to use the services the user must be of legal age and fully capable of responding for his/her actions. In the case of users who are under 18 years of age or present any restrictions to legally represent themselves and may need representation, they must be represented by the parents, or legal guardians. The user can only use the Services if complying with all the Terms, all the laws and regulations.
The Services of Woconews will be constantly evolving and can be modified without previous notice. Moreover, Woconews can stop providing the Services (or any function of the Services) permanently or temporarily to any specific user or to all users without previous notice. Plus it reserves the right to create and impose limitations of use and storage, of exclusive criteria, at any given moment without previous notice. The user is responsible for protecting the password used to access the services and whatever activities or actions under his/her password. We suggest the use of passwords that combine capital and small letters, numbers and symbols. Woconews will not be responsible for the utilization of the password by third parties.
All the information provided to Woconews will be subjected to our Privacy Policy that collects and regulates the use of information. The user understands that through the use of services, he/she agrees with the collection and use of this information, according to what is stated in the Privacy Policy including storage, processing and utilization of this information of Woconews. All the content, whether it is transmitted publically or privately is of exclusive responsibility of the person who originated it. We cannot monitor or control the content available through the Service and we cannot take responsibility for such content. Any use or dependence of any content or material sent through the Services or accessed by the user through the Services is at the user's own risk.
Woconews does not endorse, does not support, does not represent nor guarantees the integrity, truthfulness, accuracy, or trustworthiness of whichever content or communication sent through the Services. We do not advocate whatever opinions expressed through the Services. The user understands that by using the Services he/she may be exposed to content that is offensive, harmful, inaccurate and inappropriate, or in same cases that will feature misleading and mistaken titles. Under no circumstances Woconews will not be responsible for any content included, but it's not limited to, whatever mistakes, or omission in any content, or by any loss or damage of any kind incurred as a result of the use of whatever content published, sent, transmitted or made available through services or transmitted in any other place. The user will hold the rights to any content that he/she sends, posts or exhibit in the Services or through them. By sending, posting or exhibiting content, or through the Services, the user gives us an unrestricted license, which is not exclusive, free from royalties (with the right of sub licensing) to use, copy, reproduce, transform, adapt, modify, publish, transmit, exhibit and distribute the content in any given means or media of distribution, currently known or yet to be developed.
The user agrees that this license includes the right of Woconews to make available this content to other companies, organizations or individuals who have a partnership agreement with Woconews to transmit, distribute or publish such content in other media and services, subject to our terms and conditions for the use of this content.
The additional use by Woconews and other companies, organizations, or individuals who have a partnership agreement with Woconews can be made without the obligation to pay the user for the content he/she submits, publishes, transmits, or makes available through the Services.
Woconews can modify or adapt its content in order to transmit, exhibit, or distribute it to computer networks or in many communication media and/or alter in its content to format and adapt this content to attend the demand or limitations of any network, device, service or media.
The user is responsible for the use of the Services, any content he/she provides, and fo all the consequences, including the use of this content by other users and our partners. The user understands that his/her content can be re-transmitted by our partners and if the user does not have the right to send the content for that specific use, he/she will be held accountable for it. Woconews will not be responsible for any use the user' content that do not comply with these terms. The user represents and guarantees that owns all the rights, has power and authority needed to grant the rights here stated over any content that he/she submits.
Woconews grants the user a personal license, worldwide, free from royalties, not applicable and not exclusive to use the software provided to the user as a part of the Services. This license is for the sole purpose of giving him/her the use of the benefits of the Services as fixed by Woconews in the format allowed in these Terms. All the rights, titles and interests related to the Services (except the content provided by the users) are and will be of exclusive property of Woconews and its licensees. The Services are protected by copyright law, trademark and other laws that regulate both Brazil and foreign countries. Under no circumstance the user has the right to use the name Woconews, or any of its trademarks, logos, domain names or other peculiar characters of this company. Any comment or suggestion by the user about Woconews or the Services is completely voluntary and we will be able to use this feedback, comments or suggestions in whichever way we find convenient and bound to no obligation to the user. Woconews reserves the right, but is not obliged to remove or refuse distributing whatever content in the Services at any time and terminate users or retrieve user's names. Moreover, we reserve the right to access, read and promote any information that we judge necessary to (i) comply with any law, regulation, legal process or government requirement, (ii) apply the Terms, including investigation of potential violations of them, (iii) detect, prevent or other form of addressing fraud, security or technical matters, (iv) answer requests for support by the users, or (v) protect the rights of property, or security of Woconews, its users and the public.
The user cannot perform any of the following acts while accessing or using the services: (i) access, tamper, or use the areas of the Services that are not made available to the public, Woconews computer system, or any technical delivery system of Woconews providers, (ii) digitalize or test the vulnerability of any system or network, violate or cheat any security or authentication measures, (iii) serach or attempt to access or look for the Service by any means (automatized or not) except through the actual means available, published interfaces that are provided by Woconews (and only in compliance with the terms and conditions), (iv) forge the TCP/IP packet header or any piece of information from the header in any e-mail, post, or any other form or use of the Services to send changed source, misleading or false information regarding identification, or (v) interfere or disturb (or attempt to) the access of any user, host or network, including no limitation, by sending a virus, overload, flood, spam, bomb-mail, of the Services, or by script the creation of the content, in such a way to interfere or create overload for the services. Woconews respects the rights of intellectual property by others and expects the users of the services to proceed in the same way. Woconews will analyze copyright violation warnings that obey the law and legislation applicable and are rightly provided to us. If the user believes that his/her content has been copied in any way that presents copyright violation, he/she shall provide us with the following information: (i) a paper or an electronic copy of rights' owner signature or of the person who is legally able to act on his/her behalf, (ii) identification of the work the he/she claims to be violated, (iii) identification of the material he/she claims as violated or of illegal activity and therefore is to be removed or which access is to be deactivated, and sufficient information in order for us to find the material; (iv) the contact information, including mailing address, telephone number and an e-mail address, (v) a statement saying that the user is a and that the use of the material in the claimed format is not authorized by the owner of the copyrights, his agents, or by the law; and (iv) a statement saying that the information provided in the notification is accurate and to the best of his/her knowledge under penalty of perjury, that is authorized to act on behalf of the copyrights' owner.
Woconews reserves the right to remove the supposedly illegal content without previous notice and at its own exclusive criteria. Under proper conditions, Woconews will also terminate the user's account if the user is determined to be a recidivist.
The user is fully responsible for the access and use of the Services or any content. Woconews will not be responsible for any damage to the computer system; loss of data or any other damage resulted of the access or use of the Services or of any other Content by the user. The user also agrees that Woconews does not have any responsibility or obligation regarding the deletion, failure to store or transmit any content or other communication supported by the Services. Woconews does not provide any guarantees that its services will attend the needs of the user and will be available on a continuous, secure and infallible basis. No information or advice, whether it's verbal or written, obtained through Woconews or through the Services, shall create any guarantee not expressed here. Woconews makes available 07 (seven) advertisement spaces for the user to negotiate with third parties. 03 (three) of the spaces are in a banner format and 04 (four) in the format of recommendation with the advertiser's logo, with no onus to Woconews regarding the advertisement published in these spaces. The ad spaces are those allocated between the news published on your personal Woconews page. The other spaces are of exclusive use of Woconews. Six spaces will be for social entities from around the world to be chosen by Woconews and also by its users. Woconews may include ads, that may be directed to the content of the Services. Understanding that as an exchange for Woconews services, you agree that Woconews and its services providers and partners can insert such adds in the Services or related to the exhibition of the content or information of the Service that are posted by you or others. THE KIND AND SCOPE OF THE ADS POSTED ON WOCONEWS SERVICES ARE SUBJECT TO CHANGES. Woconews commits to publish only what is lawful.
The Services may present links to websites and resources that belong to third parties. The user understands and agrees that Woconews is not responsible for (i) availability or accuracy of such websites or resources, or (ii) the content, products, or services included or available on such websites or resources. The links to those websites or resources do not have the endorsement of Woconews for their content, services, products or resources on those domains. The user understands and takes full responsibility for using such sites and resources. According to the law, Woconews, its subsidiaries, affiliated companies, representatives, employees, agents, partners and licensors, WILL NOT BE RESPONSIBLE FOR WHATEVER DIRECT AND INDIRECT DAMAGE, SPECIAL OR PUNITIVE, INCLUDING LOSS OF PROFIT, DATA, goodwill, OR OTHER UNTANGIBLE LOSSES, resulting from (i) the access by the user or THE USE or impossibility of accessing or using the services, (ii) any conduct or THIRD PARTIES' CONTENT ABOUT SERVICES, INCLUDING, WITHOUT LIMITATION, ANY SLANDEROUS, OFFENSIVE OR ILLEGAL CONDUCT OF USERS or of third parties, (iii) any content obtained from the services, and (iv) non-authorized access, use o modification OF TRANSMISSIONS OR CONTENT, WHETHER IT IS BASED ON WARRANTY, CONTRACT, (INCLUDING NEGLIGENCE) OR WHATEVER JUDICIAL THEORY, EVEN if Woconews was INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF THE SOLUTION ESTABLISHED HERE is found ON ITS ESSENCIAL PURPOSE.
Some jurisdictions do not allow the exclusion of certain guarantees or the exclusion or limitation of responsibility for consequent, or incidental damage, therefore the limitations above may not be applicable to specific users. The failure of Woconews to enforce whatever right or disposition of these Terms will not be considered a waiver of such right or disposition. In the case of any provision of these Terms be considered invalid or executable, the remnant of the dispositions of these conditions shall remain in full force and effect. These Terms and whatever actions related to them will be governed by the laws of Brazil, without consideration or application of conflict of law provision of the state or of the user's country of residency. All the claims, legal procedures or judicial action related to the Services will be presented exclusively on the jurisdiction of Salvador/Brazil and the user agrees with the jurisdiction and court actions and waives any objection regarding to inconvenient foro. These terms, the Rules of Woconews, and our Privacy Policy are the entire and exclusive contract between Woconews and the user regarding the Services. These Terms cancel and substitute any previous agreement with Woconews regarding its Services.
Woconews can review these Terms at any time. The most current format will always be available at www.woconews.com. By continuing to use the Services even after these reviews are made the user agrees to abide by the reviewed Terms.
